WHAT WE DO

Matters of Economic Law have become increasingly present in the daily routine of companies and executives due to the strict enforcement of the Brazilian Antitrust Agency (CADE), the Public Prosecution Offices, Parliamentary Investigation Committees, Consumer Protection Authorities and other entities in the federal, state and municipal spheres.

We aggregate the necessary skills and expertise to advise our clients to:

Anti-bribery Law

advising and drafting reports and legal opinions;

Commercial Defense

counseling and providing reports and legal opinions;

submitting claims related to foreign trade tariffs, preferences and exemptions (e.g., ex-tariffs);

monitoring and opposing third-party claims;

representing and advising on trade remedies investigations, such as anti-dumping, anti-subsidy, safeguards and anti-circumvention;

representing and advising on matters related to the Technical Group for Public Interest (GTIP) and the Foreign Trade Chamber (CAMEX);

providing legal assistance in trade remedies-related lawsuits.

Consumer Law

general counseling, designing of business policies and guidelines, drafting reports and legal opinions;

Competition/Antitrust Law

monitoring and opposing deals adverse to our clients’ interests;

representing both complainants and defendants in government investigations (cartel-related matters, exchange of sensitive information, refusals to deal, resale price maintenance, discriminatory behavior, tie-in and bundling arrangements, among others);

Priscila’s practice has been focused in Economic Law and Compliance for more than twenty (20) years. She has extensive experience in the representation of national and foreign clients, in a broad range of sectors, including Technology, Internet, Entertainment and Media, Financial Services and Payment Methods, Footwear and Clothing, Pharmaceuticals, Food and Beverage, Education, Healthcare, Telecommunications, Energy, Outsourcing and Security, Infrastructure and Automotive.

She is a non-governmental advisor (NGA) for the International Competition Network – ICN and actively participates in ICN’s Unilateral Conduct Working Group.

Member and Counsel woman of the Brazilian Institute of Competition, Consumer Affairs and International Trade – IBRAC; Member of the International Bar Association – IBA; Member of the Section of Antitrust of the American Bar Association – ABA.

In addition to her professional and institutional duties, she has academic activities, as lecturer, speaker and teacher in courses and seminars and as a member of examining boards.

She has authored several articles, published in books and specialized magazines, and the books “Resale Price Maintenance and Suggested Retail Price in Distribution Agreements” (São Paulo, Singular, 2016), and “Compulsory Negotiations in the Antitrust Law” (São Paulo, Singular, 2010).

  • Clearance of complex transactions (national and cross border). Notification to CADE of the first transaction analyzed under the pre-merger regime established by Law 12,529/11;
  • Opposing and intervening in paradigmatic transactions;
  • Advising and representing clients in investigations regarding unilateral conducts (exclusivity clauses, resale price maintenance, discriminatory behavior, abuse of IP rights) in several industries, such as tobacco, food and beverage, footwear, health care, automotive, payment methods, collection of copyrights, entertainment, telecommunications and internet;

Mariana has more than twenty (20) years of experience in antitrust/competition law and compliance. She has conducted several merger fillings, oppositions to merger notifications, as well as investigations concerning anticompetitive behavior, including cartel and abuse of dominance cases.

She has coordinated many corporate internal investigations for Brazilian and foreign companies, in a wide range of industries – e.g. financial, health, construction, banking and public transportation – related to corruption, fraud, securities, antitrust, among others. Mariana has handled internal investigations for clients in relation to the main operations launched by the Brazilian authorities in the last years.

Camila completed the program of Administrative Law, Regulation and Competition offered by the Brazilian Society of Public Law (2014).

She was a member of the research group in Civil Law with scholarship granted by COSEAS (2010 – 2013).  

She completed an exchange program at École de Langues Accord – Paris (2011).  

She was part of the Youth Parliament promoted by the City Council of São Paulo (2002).

Along with Gabriel Mattioli de Miranda, Camila won second place in TIM-IBRAC Prize for undergraduates (2013) for the article “Implications of the Corporate Recovery regime in the Competition Law”, published in Revista do IBRAC, 25/139, 2014. She has authored papers regarding Antitrust Law.
